Gibbons Directors Howard Geneslaw and Lawrence Lustberg to Speak at 2014 New Jersey Planning Conference

Howard D. Geneslaw, a Director in the Gibbons Real Estate Land Use and Development practice group, and Lawrence S. Lustberg, co-chair o the Gibbons Commercial & Criminal Litigation, as well as the Director of the firm’s John J. Gibbons Fellowship in Public Interest & Constitutional Law, will both speak at the “2014 New Jersey Planning Conference” presented by the New Jersey Chapter of the American Planning Association on January 23-24.

Mr. Geneslaw will be speaking on a panel titled “Particular Suitability.” The panel will be comprised of planners and lawyers who will discuss the concept of particular suitability in land use applications for use or “d” variances, and specifically the import of recent court decisions and how they affect presentation of proofs in support of use variances.

Mr. Lustberg will be speaking on a panel titled “What was Mount Laurel supposed to fix? How did we do? Why is COAH so hard to reform?” Mr. Lustberg will be offering his perspective as the author of the amicus brief to the New Jersey Supreme Court, which he filed on behalf of the New Jersey State Conference of the NAACP and the Latino Action Network, in the case which recently invalidated elements of COAH’s Third Round regulations, In Re: the Adoption of N.J.A.C. 5:96 and 5:97 by the New Jersey Council on Affordable Housing, decided September 26, 2013

The two day conference covers many topics of interest to planners and lawyers, including incentives, redevelopment, climate change and fiscal impact. The program will be held at the Hyatt Regency in New Brunswick, New Jersey, and is approved for AICP Certificate Maintenance (CM) credits.
